Privacy, Cookies and Consumer Rights Notice

First Third Capital, Inc., doing business as Premier Pop Art (“Premier Pop Art,” “we,” “us,” or “our”), respects your privacy. This notice explains how we collect, use, disclose, and retain personal information when you visit premierpopart.com, create an account, ask about or purchase artwork, submit artwork for possible sale, contact us, subscribe to marketing, or otherwise interact with us.
This notice does not apply to employees or job applicants.
1. Personal Information We Collect
Depending on how you interact with us, we may collect:
Contact and identity information. Name, billing and shipping address, email address, telephone number, account credentials, and similar identifiers.
Order and transaction information. Artwork viewed, requested, offered, purchased, returned, or submitted for possible sale; order and invoice details; shipping and delivery information; communications about a transaction; and transaction status.
Payment information. Payment method, billing information, payment status, transaction identifiers, and limited payment-account details supplied by a payment provider. Payment card or bank information may be collected directly by a payment provider rather than stored by us. Do not send full card numbers, banking credentials, passwords, Social Security numbers, or identity documents by unencrypted email.
Account and communication information. Account settings, marketing choices, customer-service requests, reviews, correspondence, call notes, and other information you choose to provide.
Artwork and provenance information. Photographs, artist and title information, signature or edition information, condition, provenance, ownership history, certificates, purchase history, asking price, and related materials submitted when asking us to evaluate or purchase artwork.
Device and usage information. Internet Protocol address, browser and device type, operating system, approximate location derived from IP address, pages viewed, referring pages, interactions with the site, and cookie or similar-technology identifiers.
Compliance and fraud-prevention information. For some high-value, international, or otherwise higher-risk transactions, we may request information reasonably needed to confirm identity, prevent fraud, comply with tax or sanctions requirements, or protect the parties. We will explain the purpose and provide an appropriate submission method.
Layaway information. If you use our layaway plan, we retain the written layaway agreement, payment schedule, payments received, balance, and related communications.
Marketing preferences. Subscription status, communication preferences, and interactions with marketing messages.
2. Where Information Comes From
We may collect personal information:
Directly from you;
Automatically from your browser or device;
From Shopify and our payment, shipping, security, fraud-prevention, communications, analytics, or customer-support service providers;
From persons you authorize to act for you;
From carriers and other parties involved in a transaction; and
From public records or other lawful sources when reasonably necessary for provenance, title, fraud, sanctions, or compliance review.
3. How We Use Personal Information
We may use personal information to:
Provide, operate, maintain, and improve the site and services;
Respond to questions, requests, offers, and artwork submissions;
Create and manage accounts;
Prepare quotations, invoices, and transaction documents;
Process and confirm payments, including layaway payments;
Pack, insure, ship, track, deliver, return, or refund artwork;
Communicate about orders, delivery, account security, or customer service;
Evaluate artwork offered to us;
Authenticate users and protect accounts;
Detect, investigate, and prevent fraud, chargebacks, security incidents, and unlawful activity;
Perform identity, tax, sanctions, title, provenance, or other compliance review when appropriate;
Maintain transaction, provenance, tax, accounting, and business records;
Send marketing communications where permitted, subject to your choices;
Measure site performance and understand use, if analytics tools are enabled;
Provide or measure advertising, if advertising tools are enabled and permitted;
Enforce agreements and protect rights, customers, personnel, property, and services;
Comply with legal obligations and valid legal process; and
Complete a merger, financing, acquisition, sale, restructuring, or similar business transaction.
4. How We Disclose Personal Information
E-commerce and hosting providers. Our online store uses Shopify. Shopify receives and processes information needed to provide storefront, checkout, account, security, and related services. Shopify’s privacy materials explain its own processing.
Payment providers and financial institutions. These parties process payments, confirm transactions, address fraud, and manage refunds or disputes.
Shipping, logistics, insurance, and fulfillment providers. These parties help pack, insure, transport, track, deliver, or return artwork.
Technology and business service providers. These may support site operations, hosting, cybersecurity, communications, customer service, marketing, analytics, document management, and fraud prevention, subject to applicable contractual and legal restrictions.
Professional advisers. Attorneys, accountants, auditors, insurers, appraisers, conservators, provenance researchers, and other professional advisers where reasonably necessary.
Government authorities and other parties for legal or safety reasons. We may disclose information when reasonably necessary to comply with law or valid process, respond to a lawful request, prevent fraud or harm, enforce an agreement, or protect rights and safety.
Parties to a business transaction. Information may be reviewed or transferred in connection with a proposed or completed merger, acquisition, financing, sale, restructuring, bankruptcy, or transfer of business assets, subject to appropriate safeguards.
Other parties at your direction. We may disclose information when you authorize or direct us to do so.
We do not sell personal information for money. If enabled analytics or advertising technologies involve a disclosure that applicable law defines as sale, sharing, or targeted advertising, you may use Cookie Settings or another method described below to exercise the corresponding choice.
5. Cookies and Similar Technologies
Cookies are small files placed on a browser or device. We and service providers acting for us may use cookies, pixels, local storage, software development kits, or similar technologies.
Strictly necessary technologies support page navigation, checkout, account access, security, fraud prevention, shopping-cart operation, privacy choices, and load balancing. The site may not work properly without them.
Functional technologies, if enabled, remember optional preferences or support enhanced features.
Analytics technologies, if enabled, help us understand site traffic, performance, and how visitors interact with the site.
Advertising technologies, if enabled, may help measure advertising, limit repeated advertisements, or provide advertising based on activity over time or across services.
Some technologies expire when the browser closes; others remain for a defined period or until deleted.
You can control cookies through your browser settings, including blocking or deleting them, and you may use a legally recognized browser-based opt-out signal such as Global Privacy Control. We process such signals where required by applicable law. If we add a cookie preference centre to this site, this notice will be updated to describe it.
Rejecting non-essential cookies should not prevent an ordinary purchase, although optional features may work differently.
6. Marketing Communications
You may unsubscribe from promotional email through the unsubscribe link in the message or by contacting us. We may still send non-promotional messages concerning an order, account, security matter, request, or existing transaction.
Consent to marketing is not a condition of purchasing artwork unless a specific promotion clearly and lawfully states otherwise.
7. Retention
We retain personal information only as long as reasonably necessary for the purposes described in this notice, including to complete and document transactions; maintain provenance, authenticity, title, tax, accounting, and insurance records; provide customer service; prevent fraud and protect security; resolve disputes; and meet legal, regulatory, contractual, and recordkeeping obligations.
Retention varies according to the type and sensitivity of information, the relationship involved, and applicable requirements. When information is no longer reasonably needed, we take appropriate steps to delete, destroy, or deidentify it.
8. Security
We use administrative, technical, and physical safeguards reasonably designed for the nature of the information and our operations. No website, transmission method, or storage system can be guaranteed completely secure.
Use a unique account password and protect it from disclosure. If you believe an account or communication involving us has been compromised, contact us promptly through a method published on premierpopart.com.
We will not change wire instructions solely by an unsolicited email. Independently verify any requested change using the telephone number published on our website.
9. Your Privacy Choices and Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
Confirm whether we process your personal information;
Access or obtain a copy;
Correct inaccurate information;
Request deletion;
Obtain certain information in a portable format;
Opt out of sale, sharing, targeted advertising, or certain profiling;
Limit certain uses or disclosures of sensitive information;
Withdraw consent where processing is based on consent;
Appeal a refusal to act on a request; and
Receive equal service and pricing without unlawful discrimination for exercising a privacy right.
These rights are not absolute. We may need to retain information to complete a transaction, prevent fraud, comply with tax or recordkeeping requirements, establish or defend legal claims, or satisfy another lawful exception.

Describe the right you wish to exercise and provide enough information for us to locate relevant records. We may take proportionate steps to verify identity and authority. Do not send highly sensitive information by ordinary email.
We will acknowledge a request within 10 business days and respond within the period required by applicable law, with an operational target of 45 days. If applicable law permits an extension and one is reasonably necessary, we will notify you and explain why.
An authorized agent may submit a request where permitted. We may require evidence of authority and, where allowed, direct verification from the consumer.
To appeal a decision where an appeal right applies, reply to the decision with “Privacy Appeal” in the subject line and explain why it should be reconsidered.
10. Children
Our services are intended for adults. You must be at least 18 to make a purchase or enter a transaction with us. The site is not directed to children under 13, and we do not knowingly seek personal information from children under 13. Contact us if you believe a child has provided personal information.
11. International Visitors
We operate from the United States. If you access the site from another country, information may be transferred to and processed in the United States and other locations where our providers operate.
This U.S. notice does not replace a supplemental regional notice where one is legally required. Persons outside the United States may contact us about rights available under applicable law.
12. External Services and Social Media
The site may link to external websites, social-media services, or embedded content. Those services process information under their own notices. A link does not make us responsible for another party’s privacy or security practices.
13. Changes to This Notice
We may update this notice to reflect changes in practices, services, or legal obligations. We will post the updated notice with a revised effective date and provide additional notice when required. We will not apply a materially different practice retroactively where consent or another legal step is required.
